Our Results

We report primarily litigated results in courts of record, and do not include numerous non-judicial resolutions, preindictment matters, non-prosecution agreements, juvenile matters, and diversion agreements which we have been fortunate enough to help in obtaining. Please remember that our past results are not necessarily predictive of successful resolution of any prospective case. Criminal litigation is by its nature fraught with uncertainty; we want our clients to have a healthy outlook and reasonable expectations.

31/07/2015	A-20150022-001	Pima County Superior Court	Petition For Clearance of Records ARS § 13-4051	Client, a military professional, was arrested for DUI ARS § 28-1381 (a) (1). We filed a motion to dismiss for want of probable cause to arrest, which was granted. We then petitioned in Superior Court pursuant to ARS § 13-4051 for entry of clearance of all official records. The Prosecutor opposed; however, the Superior Court Judge granted our motion.	Petition to Clear Records GRANTED.
24/07/2015	CR- 20143210	Arizona Department of Public Safety Fingerprint Clearance Team.	Criminal Damage ARS § 13-1602	Our client, a career school teacher, and holder of Arizona Level 1 Fingerprint Clearance Card, was charged with Criminal Damage. DPS suspended her Fingerprint Clearance Card. We arranged for early dismissal of the Criminal Damage charges and reinstatement of her fingerprint clearance card.	Level 1 Fingerprint Clearance Card REINSTATED.
23/07/2015	TR-140042	Pima County Justice Court	Extreme DUI ARS § 28-1382 (a) (2) (BAC .20)	CDL Holder charged with super extreme DUI. Motion to Suppress for No Reasonable Suspicion to Stop. On reconsideration the Court granted motion.	Motion to Suppress GRANTED.
16/07/2015	TR-14112570	Tucson City Court	DUI ARS § 28-1381 (a) (1) & (2)	Motion to Suppress for interference with the right to gather exculpatory evidence. Passenger attempted to record the investigation on iPhone. Police stopped him. The court found Sixth Amendment rights violated.	Motion to Suppress all evidence GRANTED; all charges DISMISSED.
02/06/2015	TR-13134150	Tucson City Court	DUI ARS § 28-1381 (a) (1) & (2); Failure To Stop at Sidewalk ARS § 28-856 (1)	The police allegedly stopped our client for violation of ARS § 28-856 (a) failure to stop at sidewalk. However, we proved that no sidewalk existed.	Motion to Suppress GRANTED; all charges DISMISSED.
26/05/2015	CR-13-058383	Pima County Justice Court	DUI ARS § 28-1381 (a) (1) & (2); Wide Turn ARS § 28-751.1	Per official policy University of Arizona Police are supposed to maintain and disclose videos of traffic stops. Because the police failed to do so, we filed a motion to suppress the evidence.	Matter reduced to Reckless Driving; all DUI charges DISMISSED.
26/05/2015	CR-14-4209	Pima County Justice Court	DUI ARS § 28-1381 (a) (1) & (2)	Motion to Dismiss for Rule 8 Violation. Pima Community College Police Department arrested defendant but failed to disclose police report for almost six months.	All charges DISMISSED.
04/03/2015	CR-13-093655	Pima County Justice Court	DUI ARS § 28-1381 (a) (1) & (2)	Motion to Suppress evidence for lack of Reasonable Suspicion to stop; Motion to Permit Impeachment of Evidence pursuant to Ariz. R. Evid. 608. Police stopped our client allegedly for violation of ARS § 28-925 (b) No License Plate Light. We contested the matter, pulling the stop officers internal affairs file.	Matter reduced to Reckless Driving; all DUI charges DISMISSED.
01/02/2015	CR-13-058383	Pima County Justice Court	DUI ARS § 28-1381(a) (1) & (2); Red Light Violation ARS § 28-644 (a) (1)	Motion to Suppress Blood (involuntary draw). Client, a medical professional and phlebotomist, asked for attorney repeatedly. Relying on prior case law McNeely (Butler), we argued the specific facts that the consent to draw blood was not voluntary. Trial court granted our motion.	Motion to suppress evidence GRANTED; all blood evidence SUPPRESSED.
09/01/2015	CR14-051230	Tucson City Court	Domestic Violence Assault ARS § 13-1201; ARS § 13-3601	Medical professional charged with assaulting domestic partner. Matter proceeded to trial. At trial defendant acquitted of all charges.	NOT GUILTY on all charges.
19/12/2014	TR14040791	Tucson City Court	ARS § 28-1381(a)(1) & (2) DUI.	Police stopped our client for weaving and wanted him to take a breath test. Our client asked several times to have a lawyer present, but the police officer indicated that he would not wait for one to arrive. We filed a motion, arguing that police interfered with our client’s right to counsel.	Motion to Suppress GRANTED.
07/11/2014	1309964	Tucson City Court	ARS § 28-1382 Extreme DUI (BAC .227)	Career military professional found sleeping in running car. Prior to trial we argued that insufficient evidence existed that our client intended to drive.	All DUI charges DISMISSED.
24/09/2014	20656927	Tucson City Court	ARS § 28-1381(A)(1)&(2) DUI.	Police stopped Military professional in University Area & claimed he smelled like alcohol and failed a field sobriety test. We filed a motion to dismiss for No Probable Cause to Arrest. After evidentiary hearing, the trial court granted our motion.	All charges DISMISSED.
